We have summarized for you the most important changes.<\/b><\/p>\n<p><b>Consideration of leave times<\/b><\/p>\n<ol>\n<li>Leave times according to MschG and VKG (i.e. maternity and paternity leaves), starting 01.01.19, have to be considered with a maximum of 24 months for:<br \/>\n<span class=\"green\">&#8211;\u00a0<\/span>Termination periods<br \/>\n<span class=\"green\">&#8211;\u00a0<\/span>Holiday entitlement<br \/>\n<span class=\"green\">&#8211;\u00a0<\/span>Periods of payment for sick employees<br \/>\n<span class=\"green\">&#8211;\u00a0<\/span>Jubilee payments<\/li>\n<li>\n<div>End-of-life care for close relatives or care of most heavily sick children (according to AVRAG), starting 01.01.19, are also to be considered for the above mentioned entitlements \u2013 the maximum to be taken into account is regulated by law.<\/div>\n<\/li>\n<\/ol>\n<p><b>4-days-week<\/b><\/p>\n<p>The daily normal working day can be 10 hours per day for a 4-days-week. Also, these days don\u2019t have to be agreed as continuous days within a week (i.e. Monday, Tuesday, Thursday, Friday is also allowed). The employee has to apply for a 4-days-week at the employer, who can refuse within 2 weeks due to \u201corganizational reasons\u201d. For decisions on such applications the work\u2019s council has to be included.<\/p>\n<p><b>Take over of \u201etime credit\u201c or \u201etime debts\u201c into the next consideration period<\/b><\/p>\n<p>Starting January, 1st 2019 it is possible to take over \u201etime credit\u201c or \u201etime debt\u201c into the next consideration period \u2013 up to a maximum of 50% of the agreed weekly working time.<\/p>\n<p><b>Closing of shops on December, 24th at 1 pm<\/b><\/p>\n<p>The employment \u2013 and therefore also the \u201enormal working time\u201c \u2013\u00a0 ends on December, 24th at 1 pm. Exceptions, which are still applicable on January, 1st 2019 (according to \u201cemployee rest act\u201d, i.e. \u201cArbeitsruheverordnung\u201d) are remaining valid and thus excluded from this regulation.<\/p>\n<p><b>Educational leave:<\/b><\/p>\n<p>The employer has to accept an employee\u2019s application for educational leave, if:<\/p>\n<ol>\n<li>The application is made at least 6 months prior to the requested leave time<\/li>\n<li>The employee has been with the company at least one year, when making the application<\/li>\n<li>The education is relevant for the employer and all necessary documents are available<\/li>\n<\/ol>\n<p>The employer is entitled to decline an employee\u2019s application, if:<\/p>\n<ol>\n<li>Company\u2019s processes are at risk or<\/li>\n<li>Maintenance of business operations can not be guaranteed anymore<\/li>\n<\/ol>\n<p>An employee can not be terminated by the employer due to a planned or factual educational leave. This underlies the general protection of \u201cmotive termination\u201d (\u201cMotivk\u00fcndigung\u201d).<\/p>\n<p><b>Part time retirement<\/b><\/p>\n<p>If the conditions are met, the employee can inform the employer in written form, about his intention to take continuous part time retirement (\u201ckontinuierliche Altersteilzeit\u201d). This information has to contain at least the information, on how much the employee wants to reduce his weekly working time and the length of this funded part time retirement.<\/p>\n<p>The employer can do following:<\/p>\n<ol>\n<li>Postpone the part time retirement to a later point<\/li>\n<li>Talk to the employee and request a different amount of reduced working time<\/li>\n<li>Change the \u201ccontinuous\u201d part time into a \u201cblocked\u201d part time (\u201cBlockvariante\u201d)<\/li>\n<li>Decline<\/li>\n<\/ol>\n<p>if<\/p>\n<ol>\n<li>Company\u2019s processes are at risk or<\/li>\n<li>Maintenance of business operations can not be guaranteed anymore<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span class=\"green\">We are happy to assist you further, if you have any questions in regards to the applicable changes.<\/span><\/p>\n<p>Please note that all changes apply for the \u201enew\u201c and the \u201eold\u201c regulations likewise.<\/p>\n<table class=\"contenttable\" summary=\"\">\n<tbody>\n<tr>\n<td><i>Kindly keep in mind that by latest by 1.12.2021 all \u201cold\u201d salary regulations (collective agreement trade) have to be changed into \u201ctrade regulation new\u201d.
